Mortgage Defense

  • Loan Modification - A loan modification is a renegotiation of the mortgage loan.  While not always possible, the best modifications include a reduction in principal.   We assist clients in all stages of the loan modification process, from determining eligibility to programs including HAMP (Home Affordable Modification Program) and PRA (Principal Reduction Alternative) to negotiating the most beneficial terms possible on a final loan modification.
     
  • Deed in Lieu of Foreclosure - A deed in lieu of foreclosure involves conveying the Deed back to the lender in order to avoid foreclosure.  Many lenders prefer to pursue this avenue because it allows them to save on foreclosure costs, gain immediate control of the property, and still go after the borrower for a deficiency judgment. It is imperative that borrowers considering a Deed in lieu of foreclosure be represented by knowledgeable counsel that can help them avoid potential pitfalls related to this transaction.  
     
  • Short Sale - A short sale is a sale of a property for less than what is outstanding on the mortgage balance(s).  Short sales must meet certain preconditions and follow set procedures.  Many lenders will attempt to negotiate the payback of the deficiency as one of the terms of the short sale and an unwitting borrower, eager to rid themselves of their property, is susceptible to overlooking what may result to be a very costly technicality. 
     
  • Foreclosure - Foreclosure is a court process where the borrower’s interest in the property is terminated.  The property is generally sold to satisfy the debt.  Foreclosure sales are conducted by auction, with the highest bidder taking the property. While a distressed homeowner may feel helpless, foreclosure need not be inevitable.  Our firm defends homeowners against lenders in foreclosure actions.
